Terms of Service & Athletic Liability Agreement

Welcome to ApexCal and Nordic Calisthenics (collectively, the "Platform", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our web application (apexcali.app), websites (nordiccalisthenics.com), physical training facilities in Enköping, Sweden, affiliated training grounds, coaching services, and competitive events including The Apex Open.

By creating an account, booking a session, logging lifts, or entering a competition, you agree to these Terms. If you do not agree, do not use the Platform or participate in our facilities or events.

1. Assumption of Risk & Physical Training Waiver (Critical)

  1. Inherent Dangers of Heavy Calisthenics: You acknowledge that bodyweight and weighted calisthenics (including, but not limited to, weighted pull-ups, weighted dips, muscle-ups, handstands, and high-volume batteries) are rigorous physical activities carrying inherent risks. These risks include severe musculoskeletal injuries, joint dislocations, tendon tears, soft tissue damage, rhabdomyolysis, concussions, permanent disability, and death.
  2. Voluntary Participation: You affirm that you are voluntarily participating in training, testing, or competition entirely at your own risk.
  3. Medical Clearance: You certify that you are in good physical condition, do not suffer from any known cardiovascular or musculoskeletal conditions that would make extreme physical exertion dangerous, and have obtained necessary medical clearance prior to attempting any maximal lifts or tests.
  4. Complete Liability Release: To the maximum extent permitted by applicable law (including the Swedish Tort Liability Act / Skadeståndslagen and UK Consumer Rights provisions), you release, waive, and forever discharge Nordic Calisthenics, ApexCal, their founders, coaches, judges, staff, and facility landlords from any claims, liabilities, damages, or legal costs arising out of physical injury, property damage, or loss incurred on-premises or while executing platform training protocols.

2. Standardized Movement Verification & Competition Disqualifications

  1. Judge & Review Discretion: ApexCal and The Apex Open operate on strict, objective biomechanical standards. We reserve the absolute right to invalidate, downgrade, or reject any lift, benchmark entry, or video submission that fails to demonstrate mandatory lockout, requisite joint flexion angles, controlled tempo, or clean video angles.
  2. No Appeals & Decisions Final: All decisions rendered by official Apex judges or designated Coach Command reviewers regarding rank placement, leaderboard positions, and competition scoring are final and binding.
  3. Leaderboard Integrity: Any submission found to use false bodyweights, altered calibration weights, misleading camera angles, edited footage, or unsanctioned performance aids will result in immediate disqualification, lifetime forfeiture of rank points, and possible permanent account suspension without refund.

3. Account Security & Platform Subscriptions

  1. Account Registration: You agree to provide accurate, current, and verifiable information during registration (including accurate bodyweight entries for all calculated relative strength metrics).
  2. Access Security: You are solely responsible for safeguarding your credentials. Notify us immediately if you suspect unauthorized access to your account.
  3. Billing & Renewals:
    • Solo Practitioner Subscriptions: Billed on a recurring monthly or annual basis.
    • Facility & Class Memberships (Enköping): In-person recurring memberships and coaching blocks are billed according to local facility payment agreements.
    • Affiliate B2B Licensing: Gym affiliate licenses grant rights to utilize Apex software and branded leaderboards on-premises. Failure to maintain active billing immediately revokes affiliate verification rights and display access.
  4. Refund Policy: Digital subscriptions, one-time competition entry fees for The Apex Open, and consumed coaching/trial sessions are strictly non-refundable, except where required by statutory consumer law (e.g., standard EU/UK 14-day cooling-off periods for unaccessed digital content).

4. Independent Affiliate Facilities

  1. Decoupled Operation: While independent gyms, boxes, and calisthenics parks may hold an active "ApexCal Affiliate" status, each affiliate gym operates as a distinct, independent commercial entity.
  2. No Agency: Nordic Calisthenics and ApexCal do not own, operate, insure, or employ staff at independent affiliate gyms. We accept no liability for incidents, facility defects, coach negligence, or contractual disputes occurring at third-party affiliate locations.

5. Intellectual Property

  1. Proprietary Standards & Assets: The Apex Ratio methodology, rank taxonomies (Cadet, Centurion, Vanguard, Praetorian), curriculum designs, visual assets, software interfaces, and logos are the exclusive intellectual property of Nordic Calisthenics and ApexCal.

7. Governing Law & Jurisdiction

  1. Facility Operations & Swedish In-Person Services: Any disputes arising from in-person coaching, facility attendance, or events held in Sweden shall be governed by and construed in accordance with the laws of Sweden, subject to the jurisdiction of the Swedish district courts.
  2. SaaS Software & UK Business Operations: For international users of the ApexCal software platform and remote UK coaching services, these Terms are governed by the laws of England and Wales, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
